These terms and conditions (collectively called ‘terms’) are between you (the user of the website) and K2 Innovations Ltd, trading as Newton Pharmacy (named as ‘we’ or ‘our’ throughout), the operator and subsequent owner of the www.netwon-pharmacy.co.uk website. We make every effort to ensure that our terms are in plain and simple English.

By accessing this website you hereby agree to comply with and be bound by these terms. Please ensure that the terms are read in its entirety, as they may affect your legal rights. If you do not agree to adhere to and be bound by these terms, then you should terminate using the website with immediate effect.

To use this website, you must be at least 18 years of age. By using this website, you represent and agree that you are at least 18 years of age. If you are below 18 years of age, you must terminate using the website immediately.

Within these terms, the term ‘user (s)’ relate to any third party that accesses this website and not directly employed by K2 Innovations Ltd.

Accessibility to our website

Any information provided on this website is delivered in English, it is your responsibility to ensure that you fully understand the information on this website. This website is intended for people currently living in the United Kingdom, who are accessing this website from the United Kingdom and as such we cannot confirm that this information is suitable for use in other locations and as such should not be used. Accessibility to this website may be restricted in certain countries. Should there be any issues in interpreting or understanding information on this website, please make contact with us via email or phone.

If the terms have been breached, we may issue a written warning or take legal action against you as a result of breaching the terms. We will disclose all information that is legally required by a law enforcement agency in the United Kingdom. Your use of our website will be considered as taking place in the United Kingdom and as such relevant United Kingdom legal proceedings and laws will be applicable, should they be needed. This does not affect your statutory rights.

Registration

​

When registering with Newton Pharmacy you must be over 18 years of age. The details collected by us in the registration form must be completed accurately and completely. By consenting to nominating Newton Pharmacy as your ‘nominated pharmacy’ you allow us to make contact with your GP surgery or other relevant healthcare professional/provider to discuss any medication or healthcare related issues.

The decision of acceptance onto a ‘pouch based’ monitored dosage system is to be determined by a member of the pharmacy team and the superintendent pharmacists decision is final and non-negotiable. Not all medications can be stored safely in a pouch and as such may be delivered in an original pack/box alongside your pouches (if appropriate). Once we have received your prescription we may contact you using your details provided at the registration stage prior to processing your prescription.

When registering, we will ask you if you are exempt from paying the standard NHS prescription charge and the specific exemption as to why you do not pay (if appropriate). We may ask for proof of and/or the expiry date of your exemption. We use the NHS Real Time Exemption Checking (RTEC) software to verify your exemption status. If we cannot verify your status using the RTEC software, we will use the information provided by you. It is your responsibility to update us if your exemption status changes. There is a fine dictated by the NHS should the incorrect exemption be used, which Newton Pharmacy take no responsibility for should the information provided by you be used. It is therefore of paramount importance to keep us updated with your exemption status. It is your responsibility to maintain the validity of your own exemption status/relevant certificate (if appropriate).

If you have a prescription prepayment certificate, you will be classed as being exempt. It is your responsibility to ensure that this is maintained as to avoid a fine from the NHS (if appropriate).

​

When registering, you will be asked for consent to access your summary care record (SCR). This SCR contains information about you, including your name, address, NHS number and health data, full details can be found here. You can opt out of providing SCR consent all together, which can be done by contacting your GP practice. Should you wish to change you preference of us accessing your SCR to ensure that the care provided is accurate and safe, then please contact us and this can be updated.

Delivery of medications

​

We will try to accommodate an alternative address for your medication to be delivered to with your consent. However, we reserve the right to deliver your medications solely to the address listed on your prescription.

​

Newton Pharmacy uses both delivery drivers and couriers to deliver medications to patients. You acknowledge that delivery may be re-arranged or returned to the pharmacy if there is no one available to sign for the delivery. By signing up to Newton Pharmacy you acknowledge that a signature is required upon delivery, which may be from another member of the address. Please inform us or do not sign up to Newton Pharmacy if you are not comfortable with someone else receiving your medication delivery.

We use Royal Mail as our main courier provider. Their delivery times are out of our control, and we take no responsibility for the time taken for the courier to deliver your medication or missed deliveries. With your consent we will provide you with a tracking number so you can track when your package will arrive.  

​

Registration/management of medication by someone other that the patient

​

We understand that sometimes a patient may not be able to register for a service or manage their own medication. There are some scenarios when someone may have to register or manage a patients medication on their behalf. You can register with us on a patients behalf if you are legally entitled to act on behalf of a patient or the patient has given explicit consent to do so.

​

When registering for the service, use the patients details, once consent has been obtained from them (if appropriate). However, in the additional section please include details of who is completing the form as well as the reason why they cannot complete themselves as well as an expression of consent from the patient (if appropriate). ‘I’ in the registration section refers to the patient.

​

Medical advice and information

​

Newton Pharmacy is not an emergency service and must not under any circumstances be used as such. If you have a non-urgent medical concern, contact your GP surgery or NHS 111. If there is an emergency or life-threatening situation, then 999 should be contacted immediately and without hesitation.

​

Any medical information provided on this website is for information purposes only and is not a substitute for professional healthcare advice. Any medical information published is accurate at the time of publish and may become outdated, so only information on the current website should be used as medical information. This information is only applicable for patients in the United Kingdom.

All medication labels and associated packaging/leaflets must be read in its entirety prior to use. If there are any concerns or queries, then the pharmacy or GP surgery should be contacted (and the patient satisfied by the response) prior to taking the medication.

The medication pouches and cardboard outer that they are stored in are NOT child resistant. Therefore, they must be kept out of the sight and reach of children and animals. The pouches and cardboard outers should be kept in a cool dark place, below 25 degrees Celsius. Although we take precautions to try to prevent cross-contamination between medicines and allergens, we cannot guarantee that they are entirely contaminant and allergen free, please contact the pharmacy if you need further information regarding this. We are unable to place medication that is not taken every day, for example weekly, every other day or when required. For tablets that are halved, we cannot guarantee that they will be halved exactly, however we will try our best to achieve as close to half as possible.

NHS Prescriptions

​

Newton Pharmacy may, with the consent of the patient make requests for their medication from their GP surgery. The request will be transferred to the GP surgery as soon as reasonably possible. We cannot guarantee an exact time that the prescription request will reach the GP surgery or when the GP surgery will produce a prescription, if appropriate. All prescriptions are issued at the professional discretion of the prescriber. You are responsible for ensuring that this request has been received. We can only dispense medication once a legally valid prescription has been received by us.

We accept no liability for ordering your medications. The information provided to us by you will be used to generate this request. We require at least 8 working days to process your prescription, prior to dispatch.

​

You acknowledge that K2 Innovations Ltd (trading as Newton Pharmacy) is not responsible for the handling, storage, delivery and potential misuse of your medications.

​

Refunds and Exchanges

​

If you are entitled to free NHS prescriptions, then this is an entirely free service. If you are required to pay for your prescriptions you will be contacted, and the prescription will not be dispensed until payment has been received.

​

If you pay for your medication you will be charged the NHS prescription charge per item. Payment will be requested after we receive your prescription. The payment will show in your account as K2 Innovations Ltd or Newton Pharmacy. Your medical information will not be shared with your bank.


If you do not pay for your medication, you must inform us of your exemption status. We may ask you to provide evidence. You agree for Newton Pharmacy to share your exemption declaration with the NHS for verification. If the exemption information declared is incorrect, you may receive a fine from the NHSBSA. It is your responsibility to keep your exemption declaration / status up to date with us. We are not liable for any fines you receive as a result of the incorrect exemption status declared or submitted to the NHS.

Payments are only processed in Great British Pounds (GPB).

​

If you cancel any prescription items before they are dispensed by, you will receive a full refund via the payment method used initially. You can cancel the prescription by contacting us via phone. Unfortunately, as we dispense prescription medication, you will not be eligible for a refund once your medication has been dispensed. 

​

If you receive incorrect or damaged medication please phone us and we will arrange a replacement or refund.

The sole shareholder of K2 Innovations Ltd (trading as Newton Pharmacy) is K2 Healthcare Ltd (Company Registration Number: 10494256), a GP federation in South West Lincolnshire.
